At any time, you can request:
- Access to the information we hold about you;
- Rectification of information if it is inaccurate or incomplete;
- Erasure of your personal data;
- Restriction of processing in certain situations;
- Data portability in certain situations;
- Objection to processing in certain situations;
- If the processing depends on your consent or agreement and is carried out by automated means, you have the right to receive the personal data previously provided in a structured, commonly used, and machine-readable format. Your requests will be handled with special care so that we can ensure the effectiveness of your rights. You may be asked to prove your identity to ensure that the sharing of personal data is only done with the data subject.
Please note that in certain cases (e.g., due to legal requirements), your request may not be immediately fulfilled. In any case, you will be informed of the measures taken in this regard within one month from the time the request is made.
You also have the right to file a complaint with the National Data Protection Commission (“CNPD”), which you can do through the website: https://www.cnpd.pt/.
Blue4All LLC, the entity that collects and manages personal data, is committed to respecting and facilitating users' exercise of their legally recognised rights, particularly the rights of access, rectification, cancellation, and objection to data, if requested and relevant. Such rights may be exercised by the user or by a legal representative, by written request, signed and sent to our registered office.
Right of access
The data subject has the right to obtain from Forall Phones confirmation as to whether or not data concerning them are being processed, and, where that is the case, access to their personal data and access to the information provided for by law.
Right to rectification
The data subject has the right to obtain from Forall Phones, without undue delay, the rectification of inaccurate or incomplete data concerning them.
Right to erasure of data (“right to be forgotten”)
The data subject has the right to obtain from Forall Phones the erasure of their data, without undue delay, and Forall Phones has the obligation to erase personal data without undue delay, where one of the following grounds applies:
a) The personal data are no longer necessary for the purpose for which they were collected or otherwise processed; b) The data subject withdraws consent on which the processing is based (in cases where the processing is based on consent) and where there is no other legal ground for the processing; c) The data subject objects to the processing and there are no overriding legitimate grounds for the processing.
Right to restriction of processing
The data subject has the right to obtain from Forall Phones restriction of processing where one of the following applies:
a) The accuracy of the personal data is contested by the data subject, for a period enabling Forall Phones to verify the accuracy of the personal data; b) The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; c) Forall Phones no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defence of legal claims; d) The data subject has objected to processing, pending the verification whether the legitimate grounds of Forall Phones override those of the data subject.
Right to data portability
If the processing is based on the data subject's consent and that consent has been provided by automated means, the data subject has the right to receive the personal data concerning them, which they have provided to Forall Phones, in a structured, commonly used, and machine-readable format.
Right to object
Where personal data are processed for: (i) the legitimate interests pursued by Forall Phones; (ii) direct marketing purposes; or (iii) profiling, the data subject shall have the right to object at any time to the processing of their personal data.
Forall Phones declares and guarantees that it maintains levels of personal data protection security in accordance with Law no. 41/2004, of 18 August (transposing Directive no. 2002/58/EC of the European Parliament and of the Council of 12 July, concerning the processing of personal data and the protection of privacy in the electronic communications sector) and that it employs all technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access or theft of data provided by users, notwithstanding that Internet security measures are not infallible.
