Your personal data will be processed by Blue4all, LLC, legal entity no. 513783903, with registered office in Arões de São Romão, 4820-749 Fafe, registered at the Lisbon Commercial Registry (hereinafter referred to as “Forall Phones” or “We”). This company is the Data Controller of your personal data, within the meaning of the General Data Protection Regulation.

For matters related to the processing of your personal data, please contact us (business days, from 10:00 AM to 1:00 PM and from 2:00 PM to 6:00 PM) at the email address hello@forallphones.com.

Some Forall Phones services do not need any form of registration, allowing you to visit our website without providing any data that may identify you. However, the ordering service implies that you provide some personal data. In this case, if you choose to refuse providing the requested information, it may not be possible to access all the relevant services, as well as receiving answers from our part. Forall Phones, will only use personal information when provided by its subjects, for the purposes to which it was provided and always with the consent from the subjects.

2. Internet access information

Some computer information is collected automatically by accessing the Forall Phones website, which is also automatically deleted after a certain period of time. The collection of this information has merely technical purposes, such as connection configuration, system security, network technical administration and website optimization. This information includes:

• IP address from the requesting processor;
• Access date and time;
• Name and URL of the transferred file;
• Volume of transmitted data;
• Indication on whether the transfer was successful;
• Software identification data from the browser and operative system;
• Place on the web from where you accessed our website;
• Name of the Internet service provider.

2. Consent for the use of personal information

2.1 User registration

To register at Forall Phones you should click on the Login menu and/or Create Registration, and follow the instructions. The reading and express acceptance of the Terms and Conditions for the Use of Forall Phones and its Privacy Policy is mandatory to successfully conclude the registration. Some personal information is requested in this form, such as your name, date of birth, e-mail address and password. After registration, the user will have access to their information, in order to verify, rectify or change it. The choice for username and password is of exclusive responsibility of the user, in order to ensure confidentiality of their information. The collection of this information aims for the creation and management of your registration profile, in order to simplify and improve your user experience on Forall Phones.

2.2 Login with Facebook

Besides the user login or registration mentioned in the previous number, you may choose to login to the Forall Phones website with your Facebook registration, if you are a user of that social network. In this case, Facebook will automatically send to Forall Phones the personal information that is in your public Facebook profile, your date of birth and your e-mail address, and the user can expand or restrict this information, according to the tool Facebook uses for that.

2.3 Receive all news exclusively

Forall Phones users and visitors have access to a free newsletter service. This service aims to let its subscribers know relevant information within the area of interest covered by the services provided by Forall Phones. In order to use this service you will have to fill your name and e-mail address in the appropriate field. You can cancel the newsletter service subscription at any time, you only need to send an e-mail with that request or follow the instructions at the end of every newsletter, in order to do that.

2.4 User support

We try to constantly improve our services, so your comments, suggestions and contacts are very welcome. Forall Phones has a direct and simplified contact form for that in the Contacts menu, accessible through the available link at the bottom of the page. Here, some personal information will be requested (name, e-mail address and phone contact), only for the purpose of responding to your contact with a minimum of personalization. This information will not be forwarded to third parties. If you prefer, you can also contact Forall Phones directly to the e-mail hello@forallphones.com.

Forall Phones will process your data for the following purposes:

2.1. Customer management and order processing:

The processing of your data is necessary for authentication, invoicing, and order processing within the scope of the conclusion and execution of purchase and sale contracts, as well as for carrying out pre-contractual steps at your request. If you do not provide your data, we will not be able to provide you with the requested or contracted services.

Your data will be retained for this purpose for 2 years.

The personal data of customers may also be processed by Forall Phones for the purpose of litigation management. The legal basis is the existence of a legitimate interest on the part of Forall Phones, and the data will be retained for the period necessary to exercise the respective rights.

2.2. Marketing

Forall Phones may process your data to send you marketing communications (including news, sales, promotions, events, information about products and services, exclusive offers for customers, and satisfaction surveys about the services provided) via email and SMS.

This data processing will only be carried out with your consent, provided through a specific form available on our website. Failure to provide your personal data (in this case, your email/mobile number) will prevent Forall Phones from sending you commercial communications.

Your data will be retained for this purpose only for the period strictly necessary to execute the purpose for which it was collected or, as the case may be, until you exercise your right to object or right to erasure. After this retention period, Forall Phones will delete your personal data.

2.3. Management of complaints and contacts received by Forall Phones

You can send us suggestions or complaints regarding the services provided by Forall Phones to the email address apoio@forallphones.com. Your personal data will be processed based on the legitimate interests of Forall Phones and your consent. Forall Phones collects your data to analyse and resolve the situation underlying your suggestion or complaint.

For this purpose, your data will be retained for the time necessary to resolve your issue, and up to a maximum of 2 years from the submission of the suggestion or complaint.

Your information may be disclosed to third-party service providers.

If you are our customer or supplier, your personal data may be processed by companies subcontracted by Forall Phones, namely for the hosting of our website, electronic mail, order distribution and collection, insurance on purchased equipment, invoicing platforms, and payment processing platforms. Only the personal data necessary for the provision of the respective service will be provided.

Your personal data may also be accessed by internal and external auditors of Forall Phones, with the guarantee that they are kept confidential and will not be used for purposes unrelated to the audits.

Your data will be processed only within the European Union.

At any time, you can request:

• Access to the information we hold about you;
• Rectification of information if it is inaccurate or incomplete;
• Erasure of your personal data;
• Restriction of processing in certain situations;
• Data portability in certain situations;
• Objection to processing in certain situations;
• If the processing depends on your consent or agreement and is carried out by automated means, you have the right to receive the personal data previously provided in a structured, commonly used, and machine-readable format. Your requests will be handled with special care so that we can ensure the effectiveness of your rights. You may be asked to prove your identity to ensure that the sharing of personal data is only done with the data subject.

Please note that in certain cases (e.g., due to legal requirements), your request may not be immediately fulfilled. In any case, you will be informed of the measures taken in this regard within one month from the time the request is made.

You also have the right to file a complaint with the National Data Protection Commission (“CNPD”), which you can do through the website: https://www.cnpd.pt/.

Blue4All LLC, the entity that collects and manages personal data, is committed to respecting and facilitating users' exercise of their legally recognised rights, particularly the rights of access, rectification, cancellation, and objection to data, if requested and relevant. Such rights may be exercised by the user or by a legal representative, by written request, signed and sent to our registered office.

Right of access

The data subject has the right to obtain from Forall Phones confirmation as to whether or not data concerning them are being processed, and, where that is the case, access to their personal data and access to the information provided for by law.

Right to rectification

The data subject has the right to obtain from Forall Phones, without undue delay, the rectification of inaccurate or incomplete data concerning them.

Right to erasure of data (“right to be forgotten”)

The data subject has the right to obtain from Forall Phones the erasure of their data, without undue delay, and Forall Phones has the obligation to erase personal data without undue delay, where one of the following grounds applies:

a) The personal data are no longer necessary for the purpose for which they were collected or otherwise processed; b) The data subject withdraws consent on which the processing is based (in cases where the processing is based on consent) and where there is no other legal ground for the processing; c) The data subject objects to the processing and there are no overriding legitimate grounds for the processing.

Right to restriction of processing

The data subject has the right to obtain from Forall Phones restriction of processing where one of the following applies:

a) The accuracy of the personal data is contested by the data subject, for a period enabling Forall Phones to verify the accuracy of the personal data; b) The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; c) Forall Phones no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defence of legal claims; d) The data subject has objected to processing, pending the verification whether the legitimate grounds of Forall Phones override those of the data subject.

Right to data portability

If the processing is based on the data subject's consent and that consent has been provided by automated means, the data subject has the right to receive the personal data concerning them, which they have provided to Forall Phones, in a structured, commonly used, and machine-readable format.

Right to object

Where personal data are processed for: (i) the legitimate interests pursued by Forall Phones; (ii) direct marketing purposes; or (iii) profiling, the data subject shall have the right to object at any time to the processing of their personal data.

Forall Phones declares and guarantees that it maintains levels of personal data protection security in accordance with Law no. 41/2004, of 18 August (transposing Directive no. 2002/58/EC of the European Parliament and of the Council of 12 July, concerning the processing of personal data and the protection of privacy in the electronic communications sector) and that it employs all technical means at its disposal to prevent the loss, misuse, alteration, unauthorized access or theft of data provided by users, notwithstanding that Internet security measures are not infallible.

If consent is legally required for the processing of personal data, the data subject has the right to withdraw consent at any time, although this right does not affect the lawfulness of the processing carried out based on the consent previously given nor the subsequent processing of the same data, based on another legal basis, such as the fulfilment of the contract or legal obligation to which Forall Phones is subject.

Forall Phones collects and processes information about your visit to our site and the respective pages visited, the site you came from, and some of the searches you conducted on search engines.
